Liability Release

This liability waiver covers all yoga classes (in person or online), workshops, therapies, retreats and private sessions offered by Yoga for All LLC (Yoga for All yoga events).

I am at least 18 years of age and otherwise legally competent to sign this agreement.

I am participating in yoga classes, workshops, therapies and private sessions offered by Yoga for All during which I receive information and instruction about healthy and safe practices. I understand that yoga includes intense physical movement, stretching and balancing poses.

I recognize that yoga classes, workshops, therapies and private sessions may require physical exertion, which may be strenuous and could result in physical injury, and I am fully aware of the risks and hazards. As a result, as is the case with any rigorous physical activity, I understand that the risks of injury – even serious or disabling, including death – from practicing yoga, are inherent and are always present and cannot be entirely eliminated. I understand and voluntarily accept these risks inherent in the yoga classes, workshops, therapies and private sessions offered by Yoga for All.

  If I feel uncomfortable practicing poses or sequences suggested by my teacher, I will listen to my body and discontinue my participation until I feel ready to resume.  In most cases teachers will offer alternatives and/or modifications.  To ensure I remain free from injury, I will become familiar with and abide by the prerequisites of classes, workshops and therapies I plan to attend (located on the class description page of the website).  

I understand that some classes, workshops, therapies and private sessions take place in a heated room. If I experience any discomfort resulting from the heat or humidity, I will listen to my body and will promptly discontinue my participation in the class, workshop, therapy or private session. I will notify staff if I require assistance.

I understand that in some classes, workshops, therapies and private sessions teachers will suggest use of props (including, but not limited to: blocks, blankets, bolsters, mats, straps, therapy balls and walls) as a means to support or correct alignment.  I will only use these props while under the supervision of a Yoga for All teacher.  I understand that use of these props does not eliminate the inherent risk of practicing yoga.  If I experience any discomfort resulting from the use of these props, I will listen to my body and will promptly discontinue use. I will notify staff if I require assistance.  I will only use these accessories for the purposes intended.  I will not, under any circumstances, use columns, doors, mirrors or windows as props.  

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in yoga classes, workshops, therapies and private sessions. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in these classes, workshops, therapies and private sessions. I understand that a physician’s release may be required to participate in certain classes, workshops, therapies and private sessions. If I experience any pain or discomfort, I will listen to my body and promptly modify or discontinue the movement or pose. If I am pregnant or become pregnant, I affirm that I will notify Yoga for All staff and will consult with and obtain approval from my physician before continuing to practice yoga or any other form of exercise.

I assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in yoga classes, workshops, therapies and private sessions offered by Yoga for All.  I agree to inform my teacher of any physical limitations, physical discomfort and/or injuries before or during classes, and I take full responsibility for nondisclosure.

I understand yoga teachers offer hands-on assists to correct alignment.  I recognize that hands-on assists are used to prevent injury.  I hereby consent to receive hands-on assists from Yoga for All yoga teachers and/or assistants while participating in yoga classes, workshops, therapies and private sessions. When I prefer not to receive hands-on assists, I will clearly verbalize this to my teacher before or during class.

This waiver is effective and binding upon me and my heirs, survivors, representatives, executors, and administrators.  I hereby irrevocably waive any claims that I have now or hereafter in connection with any injury (including death or disability) I may sustain in connection with the practice of yoga or other exercise.  

I understand and agree that Yoga for All is not liable (and I hereby indemnify and holdYoga for All harmless from) for any loss of, damage to, or theft of any of my personal property while I am visiting any Yoga for All. 

I understand and agree that Yoga for All reserves the right to refuse services to some individuals in some cases.

I have read the above waiver of liability and fully understand its contents.  I understand that this waiver is a legally binding contract.  No oral representations, statements, or inducements apart from the above written agreement have been made.  I have read, understand and am familiar with all of its provisions, and I voluntarily agree to its contents.

RELEASE AND WAIVER OF COVID-19 LIABILITY

PLEASE READ THIS RELEASE AND WAIVER OF COVID-19 LIABILITY ("RELEASE") CAREFULLY AND IN ITS ENTIRETY. IT IS A BINDING LEGAL DOCUMENT AND BY SIGNING IT YOU ARE VOLUNTARILY  GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE (YOGA FOR ALL LLC)

I am participant at Yoga for All hereby agree as follows:

ACKNOWLEDGEMENT OF RISKS

I acknowledge that COVID-19 infections have been confirmed throughout the United States, including in Massachusetts. I understand that although YOGA FOR ALL intends to follow guidance and protocols recommended by the Commonwealth of Massachusetts and the Centers for Disease Control, there are unavoidable risks associated with exercising indoors and using shared equipment and common spaces.
 

EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY
I am willingly and voluntarily attending and participating in the use of YOGA FOR ALL. facilities, programs and services and I agree I am assuming all dangers, hazards and risks (foreseen and unforeseen) inherent in, arising from or related to my attendance and participation at YOGA FOR ALL. This may include exposure to COVID-19 and any consequences thereof, including quarantine requirements, financial losses, illness, disability and/or death.

I authorize YOGA FOR ALL to arrange for medical treatment for me should I become ill or incapacitated without incurring any liability. I release YOGA FOR ALL from any liability for the quality, timeliness and outcome of any such medical care received. I understand I am responsible for all medical expenses I incur during my participation in the programs and activities of PERFORMANCE.

PARTICIPANT RESPONSIBILITIES
I agree, represent and warrant that I shall not visit or utilize YOGA FOR ALL facilities, services or programs (other than exclusively online programs) within 14 days after 1) international travel; 2) exposure to any person returning from international travel; 3) exposure to any person who has had a suspected or confirmed case of COVID-19. I agree, represent and warrant that I shall not utilize YOGA FOR ALL facilities, services or programs and shall notify YOGA FOR ALL if I have utilized their facilities, services or programs within 14 days if I 1) experience symptoms of COVID-19, including, without limitation, fever, cough or shortness of breath/difficulty breathing, chills, muscle pain, sore throat, or new loss of taste or smell, or any other symptoms that may be identified by the Center for Disease Control; or 2) have a suspected or diagnosed/confirmed case of COVID-19.

I understand that YOGA FOR ALL has put in place procedures to reduce the risk of exposure to COVID-19 and I agree that I will follow all YOGA FOR ALL guidelines, signage and procedures. I acknowledge that if I fail to follow any such procedures, I may be asked to leave the facility immediately. I further acknowledge and agree that YOGA FOR ALL may revise its procedures at any time based on updated guidance and I agree to comply with the procedures as updated and revised prior to utilizing YOGA FOR ALL facilities, programs or services.

WAIVER OF PERFORMANCE LIABILITY/COVENANT NOT TO SUE/RELEASE AND HOLD HARMLESS
In consideration of my attendance and participation at YOGA FOR ALL knowing the dangers, hazards and risks (foreseen and unforeseen) of attending and participating in YOGA FOR ALL programs, I agree to forever RELEASE YOGA FOR ALL from and and all liability and for any and all claims, demands, and causes of action for any and all loss of personal property, exposure to COVID-19, illness or injury to me or others, including death, arising out of, caused by or occurring during, or in any way connected with YOGA FOR ALL and/or any participation or contact incident thereto however the injury or loss is caused, including whether caused by the negligence of myself, YOGA FOR ALL , another YOGA FOR ALL participant or otherwise. I COVENANT NOT TO SUE and agree to forever INDEMNIFY AND HOLD HARMLESS YOGA FOR ALL from any and all causes of action, claims, demands, losses, or costs of any nature (including reasonable attorneys’ fees in defending any such claim or cause of action brought against YOGA FOR ALL arising out of or related to my participation in any way in the programs and curriculum of YOGA FOR ALL.

ACKNOWLEDGEMENT
It is my express intent that this Release shall bind me, my family, estate, heirs, administrators, personal representatives or assigns. The term “YOGA FOR ALL" includes YOGA FOR ALL current and former owners, officers, employees, agents, contractors, guest instructors, substitutes, other participants at YOGA FOR ALL, representatives and assigns. I acknowledge that I have read and understand this document and the RELEASE, COVENANT NOT TO SUE AND HOLD HARMLESS provisions. I understand this Release shall be construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to the conflict of laws provisions thereof, and that the Commonwealth of Massachusetts shall be the forum for any lawsuits filed under or incident to this Release. The terms and provisions of this Release shall be sever-able, such that if a court of competent jurisdiction holds any term to be illegal, unenforceable, or in conflict with any law governing this Release the validity of the remaining portions shall not be affected thereby, and each and every term and condition of this Release shall be valid and enforced to the fullest extent and in the broadest application permitted by law.
